General Terms and Conditions (GTC)

1. Scope

These Terms and Conditions apply to all purchases made through our online shop HELLIORA®. They govern the contractual relationship between HELLIORA® (hereinafter "Seller") and consumers or businesses who place an order on our website.

Consumers are natural persons who place an order for purposes that are primarily personal and not related to a trade or profession. Businesses are natural or legal persons acting in the course of their trade, business, or profession.

2. Conclusion of Contract

All product listings in our shop are non-binding and represent an invitation to place an order.

By submitting your order at checkout, you make a binding purchase offer. The contract is concluded when we confirm your order by email, ship the goods, or request payment.

For payments made via PayPal, Klarna, or Shopify Payments, the contract is concluded at the time the order process is completed.

A copy of the contract details will be sent to you via email. The contract language is English.

3. Right of Withdrawal (Returns)

Consumers have the right to return their order within 30 days without giving any reason. For full details regarding eligibility, process, and deadlines, please refer to our separate Return Policy.

4. Prices and Payment

All prices are shown in USD and include applicable sales tax where required. Shipping costs, if applicable, are displayed separately.

For international deliveries, additional fees such as customs duties, import taxes, or bank charges may apply and are the responsibility of the customer.

The available payment methods (e.g., PayPal, Klarna, credit card, Shopify Payments) are displayed at checkout.

5. Shipping and Delivery

Orders are shipped to the delivery address provided during checkout. For PayPal payments, the address registered with PayPal is binding.

If delivery fails due to reasons for which the customer is responsible (e.g., incorrect address), the customer will bear the additional costs.

Orders are usually processed within 48 hours. Standard delivery time is 5–10 business days. Business days are Monday to Friday, excluding weekends and public holidays.

If an item is unavailable, we reserve the right to cancel the contract. You will be informed immediately, and any payment already made will be refunded.

6. Retention of Title

The goods remain the property of HELLIORA® until full payment has been received.

7. Warranty and Liability

For consumers, statutory warranty rights apply.

For businesses, the warranty period for new goods is one year. Used goods are sold “as is” without warranty. The choice of remedy (repair or replacement) lies with us.

Claims for damages in cases of fraudulent concealment or intentional misconduct remain unaffected.

8. Governing Law

These Terms and Conditions are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions.

If you are a consumer and your habitual residence is outside the USA, you may also have mandatory consumer protection rights under the laws of your country of residence.

9. Dispute Resolution

The Seller is not obligated to participate in alternative dispute resolution before a consumer arbitration board. However, we aim to resolve all issues directly with our customers. Please contact us at help@helliora.de if you have any concerns.
